In light of consistently changing estate and probate tax laws, our firm activitely assists clients in the preparation and maintanence of their wills, trusts, and other imperative estate planning documents. In many cases, our clients are surprised to find that their estate plan may need to be updated to cohere with current Florida Statutes and IRS Codes. We are happy to arrange consultations to answer these and other questions. For over three decades, we have advised thousands of residents of the Marco Island community. We're honored to continue in this tradition.
The passing of a loved one can unfortunately lead to many legal questions. The State of Florida requires numerous filings for the proper disbursement of funds, administration of trusts, and the settlement of an estate. Over the years, our firm has handled the probate of a great deal of estates. Oftentimes, our clients chose to name one of our partners as the personal representative for their will or the co-trustee of their trust. We work diligently to ensure that the final wishes of our clients are properly fulfilled.
Over 35 years ago, Dusty Rhodes started one of Marco Island's first law firms, focusing primarily on both commericial and residential real estate law. These many years later, our firm has overseen countless real estate closings, and our real estate closers, Vicki Hodge and Cheri Bowen, each have over a decade of experience. Although we already proudly serve many of Marco's premier realtors, residents, visitors, and commercial owners, we invite new clients to see firsthand the difference our years of experience can make.

With over 30 years of legal experience, Brenda Garretson is an expert in the resolution of civil and family law matters through mediation or arbitration. As an arbitrator, a certified circuit civil court mediator, and a certified family law mediator, Mrs. Garretson has developed a reputation as the mediator or arbitrator to call for matters that seem unsolvable. Her curteous and thoughtful demeanor and her strong sense of fairness more often than not facilitate an agreement between opposing parties upon a settlement outside of court.

Our Awards

The Attorney's Title Fund ("The Fund"), a nationwide title insurance company, awards the President's Circle Award and the Top 100 Award to law firms ranked among the top 100 real estate closers for that year (calculated by the total value of all properties closed through each firm; approximately 4300 firms are considered). Rhodes, Tucker, and Garretson has consistently received one of these two awards nearly every year since 2001.

Dusty Rhodes

Education:U.S. Naval Academy, B.S., 1962University of Miami School of Law, J.D., 1973Experience:Dusty was the founding partner of the firm in 1975. His experience is primarily in real estate law, real estate ventures, and commercial and residential real estate closings.Activities:Dusty is also a retired commercial airline pilot for a major U.S. carrier. He served for six years as a designated pilot for the White House Press Corps., which accompanies the President on his travels throughout the world. Dusty is a former chairman of the State of Florida Elections Comission, an appointment made by the governor; he was reappointed to a second term in 2008. This responsibility includes deciding when laws relating to the Florida election process, campaign reporting, and campaign tactics have been violated.

Brenda Garretson

Education:University of Northern Iowa, B.S., 1974University of Tulsa, College of Law, J.D., 1977Experience:Prior to entering the private sector, Brenda served as an elected Collier County Judge and, at times, an appointed Circuit Court Judge. During her tenure on the bench, she presided over civil and criminal court matters. Owing to her many years of experience, Brenda wears many hats at Rhodes, Tucker and Garretson. Her practice primarily consists of estate planning, probate, and corporate planning. She assists in dispute resolution as an arbitrator, a certified civil court mediator, and a certified family law mediator. She further serves as the Special Magistrate for Collier County Code Enforcement.Activities:Brenda has been active in numerous organizations on the national, state, and local levels including the National Judicial College, Leadership Collier, and the Naples Area Chamber of Commerce. She's been elected President of the Forum Club, President of the Collier County Bar Association, and Charmain of the Domestic Violence Task Force.

Vicki Hodge

Vicki joined the firm in 1999. She has over 15 years of experience closing real estate transactions for properties located both on Marco Island and in Naples.

Cheri Bowen

Cheri has worked in the banking and real estate fields on Marco Island for over twenty years; she joined Rhodes, Tucker and Garretson in 2006. Her role at our firm includes all aspects of closing real estate transactions.

Tyler Wilson

Tyler Wilson

Tyler graduated from Johns Hopkins University with a double major in Film and Philosophy. He spent the next two years working for PBS and various production companies in Los Angeles. After returning to Naples last year to apply to law school, he joined the staff at Rhodes, Tucker and Garretson. He has been accepted to and will attend in the fall the University of Pittsburgh School of Law.

Whitney Wilson

Whitney Wilson recently graduated from University of Central Florida with a Bachelors of Science in Legal Studies, minoring in Sociology. In addition to her responsibilities as a legal assistant, she assists with the firm's finances and accounting.
